Home Health, Home Care, Adult Day Services, and Community-Based Services

Reimbursement programs are forcing a shift in the health care delivery system from institutional care to home and community-based services. In addition, older adults are desiring to remain in their homes and communities rather than residing in an institutional setting. We recognize this trend, and have expanded our practice to include representation of a number of home health, home care, adult day care service, and community-based service providers. Our attorneys can assist providers to both acquire and develop home health and home care agencies, adult day services, and community-based service organizations. We have actively guided clients through the often complicated and rapidly-changing regulatory framework governing the delivery of home health, adult day services, home care, and community-based services.

Certain home and community-based services are eligible for funding through a special waiver of certain Medicaid rules, allowing payments typically used for nursing home care to be used for home care services. In Pennsylvania, the Department of Public Welfare administers multiple Medical Assistance/Medicaid waivers, each with its own unique set of eligibility requirements and services. We have assisted clients with the enrollment process for various “waiver” programs, including the Aging Waiver and the Office of Developmental Programs waivers for individuals with intellectual disabilities.
