As a hybrid provider of a continuum of services, CCRCs face legal and regulatory issues not confronted by other free-standing, long term care providers. We have a wide range of experience in helping our clients obtain a Certificate of Authority from the Department of Insurance, drafting residency agreements and disclosure statements, and resolving the regulatory and structural issues related to developing and maintaining a CCRC. We have gained valuable knowledge and experience from representing CCRCs since the advent of the Continuing-Care Provider Registration and Disclosure Act in 1984. The representation of CCRCs is a significant focus of our Firm’s practice. We are familiar with the operational challenges faced by our CCRC clients, including the challenges associated with level-of-care transfers and “aging-in-place”, and provide seasoned guidance on compliance issues.
