Latsha Davis & Marshall P.C. to Co-Present at Lehigh University's 47th Special Education Law Conference Friday, May 10, 2019

Sarah B. Dragotta, Esq., Associate, Master of Education from Lehigh University, and a long-time member of the Lehigh University Special Education Conference Planning Committee, will moderate at Lehigh University's 47th Annual Special Education Conference.

Attorney Dragotta will moderate the following topic, along with her co-presenters, Aimee R. Zundel, Esq., Associate, Weiss Burkhardt Kramer, LLC, and Judith A. Gran, Esq., Shareholder, Reisman Carolla Gran LLP: "Security of Schools and of Students With Disabilities Before and After Disasters." School shootings, natural disasters, and pollution problems, such as the Flint lead crisis, are on the increase. This session will focus on legally-based recommendations for students who are eligible under the IDEA and Section 504 in preparation for, during, and after such disasters (1) to minimize the harmful effects on their learning and sense of security and (2) to understand the potential exposure of schools to child find and FAPE violations and to common law and constitutional tort liability for money damages.

The presentation will include strategies for evacuating the Special Needs Population, information regarding various rulings from state and federal courts, as well as administrative OCR and State Due Process, and the Federal Emergency Management Agency's (FEMA) recommended procedures for conducting student drills. Additional discussion will include national case studies, such as the displacement of Special Education Students in Puerto Rico to Florida in the aftermath of Hurricane Maria, and the impact of those transfers on the education system of the State of Florida. Additional resources will include practical information, checklists, and resources for planning for students with disabilities in emergency disaster situations.
