How the courts interpret Endrew F. is a very important special education case for our parents, as well as for our school clients. In Spring 2017, the United States Supreme Court issued the long-awaited decision in the matter of Endrew F. v. Douglas County School District, 137 S.Ct. 988 (2017). The Supreme Court raised the bar by setting a "new" standard for what schools are required to provide for a Free Appropriate Public Education (FAPE) under the Individuals with Disabilities Education Act (IDEA). While it could be argued that our United States Court of Appeals for the Third Circuit already holds to a high standard concerning what exactly is "meaningful progress" under the IDEA, this issue will continue to be debated due to the language used by the Supreme Court in Endrew F. The Court held that to offer FAPE, "a school must offer an IEP reasonably calculated to enable a child to make progress appropriate in light of the child's circumstances." Endrew F., at 999. This presentation will provide insight into how this case affects our charter school and cyber charter school clients, as well as school districts and parents of children in special education.
