DOL Delays Employer Notice Requirements under Affordable Care Act

The U.S. Department of Labor (DOL) announced on January 24th that employers will not have to provide notices about the Exchanges established under the Affordable Care Act (ACA) until later this summer or fall. The ACA amended the Fair Labor Standards Act (FLSA) to require applicable employers to provide each employee at the time of hiring (or with respect to current employees, not later than March 1, 2013), a written notice informing employees of, among other things, the existence of Exchanges, a description of the services provided by the Exchanges, and the manner in which an employee may contact Exchanges to request assistance.

New FMLA Guidance From DOL

The U.S. Department of Labor (DOL) recently issued a new interpretation with regard to the Family and Medical Leave Act (FMLA). It provided guidance on the definition of "son or daughter" under the FMLA as it applies to an individual 18 years of age or older and incapable of self-care because of a mental or physical disability. As a result of the interpretation, it is likely that employers will receive more requests for leave from employees seeking to care for adult children.

New HIPAA/HITECH Regulations for Health Care Providers

On January 17, 2013, the Department of Health and Human Services ("HHS"), Office of Civil Rights issued its final rule modifying the HIPAA Privacy, Security, Enforcement and Breach Notification Rules under the Health Information Technology for Economic and Clinical Health Act ("HITECH").
