Significant Decision Impacting Charter Schools plus Award Recognition for Latsha Davis & McKenna, P.C.

Latsha Davis & McKenna, P.C. is pleased to announce that on February 16, 2016, the Supreme Court of Pennsylvania issued a significant decision positively impacting charter schools. In West Philadelphia Achievement Charter Elementary School (WPACES) v. School District of Philadelphia (District) and School Reform Commission (SRC), Case No. 31 EM 2014, our firm, on behalf of Amicus Curiae parties, the Pennsylvania Coalition of Public Charter Schools and MaST Community Charter School, submitted a Brief in Support of WPACES. The Pennsylvania Supreme Court held that Section 696(i)(3) of the School Code is unconstitutional as it violates the non-delegation rule of Article II, Section 1. Accordingly, the SRC's and School District's actions taken pursuant to that provision are null and void and the District and SRC are permanently enjoined from taking further action under the authority it confers.

Commonwealth Court hands major victory to charter schools

Latsha Davis & McKenna, P.C. is pleased to announce a victory on behalf of charter schools. In 2010 the School Reform Commission moved to cap enrollment in and payments to city charter schools that had agreed to limits, but it declined to do so under new charters. Various charter schools which Latsha Davis & McKenna represented joined in a suit claiming the caps were illegal. On August 27, 2015, the Commonwealth Court of Pennsylvania ruled that the Philadelphia School District does not have the power to override state law and limit charter-school enrollment.

Court Rules in Favor of Charter Schools on Chester Upland Funding Plan

Latsha Davis & McKenna, P.C. is pleased to announce an important victory on behalf of charter schools and cyber charter schools. On August 25, 2015, the Delaware County Court of Common Pleas entered an Opinion and Order in In Re: Appointment of a Receiver for the Chester Upland School District that prevents the Pennsylvania Department of Education and the Chester Upland School District from implementing portions of a proposed Amended Financial Recovery Plan aimed at decreasing charter school and cyber charter school subsidies. After a two-day hearing in which our office participated on behalf of several charter schools and cyber charter schools, the court disapproved the arbitrary and capricious proposed reduction in cyber charter school tuition rates and held the initiative on special education funding to be wholly inadequate.
