2014 OAPCS 8th Annual State Conference

On Thursday, October 16, 2014 at 11:00 a.m., Kevin M. McKenna, Esq. and Nicole D. Snyder, Esq., will be presenting at the Ohio Alliance for Public Charter Schools (OAPCS)  http://www.oapcs.org/event/725 conference at the Kalahari Resort in Sandusky, Ohio. Final PSAE Rules Issued By DPW

On September 13, 2014, DPW issued its final rule addressing Preventable Serious Adverse Events (PSAE) for nursing facilities. The PSAE requirements become effective October 1, 2014, subject to CMS approval of a related state plan amendment.  Once effective, a nursing facility may not seek payment from a resident or a health care payor (including the Medical Assistance Program) for a PSAE (as defined within the regulations) or for any corrective services following a PSAE. Further, a nursing home that discovers it was paid for such services is required to refund such payments to either the resident or the health care payor within 30 days of discovery. Further information on reporting methods, claims and best practices can be found on DPW's website.

Pennsylvania Supreme Court Upholds Real Estate Tax Exemption Obtained By LDM For CCRC Client

By Order.pdf dated August 29, 2014, Pennsylvania Supreme Court upheld the Opinions.pdf of the Pennsylvania Commonwealth Court and Union County Court of Common Pleas, through which our Firm successfully obtained real estate tax exemption for Albright Care Services' CCRC located in Union County. In its Order, the Pennsylvania Supreme Court denied the taxing authorities' Petition for Allowance of Review, effectively ending the case, and confirming exemption for Albright's CCRC under the decisions of the lower courts. Kimber Latsha tried the case for our Firm.
