David
C. Marshall graduated from James Madison University (B.S.) and the
Dickinson School of Law of the Pennsylvania State University
(J.D.). Mr. Marshall has been admitted to the Pennsylvania Bar.
While in law school, he was a member of the Appellate
Moot Court Board and the Dickinson Law Review (1994-1995). He is
the author of “Political Asylum: Time For A Change - The Potential
Effectiveness of Reforms To Prevent Terrorist Attacks in America”,
95 Dick. L. Rev. 1017 (Summer 1995). Mr. Marshall also is
co-author of the Pennsylvania Association of Non-Profit Homes for
the Aging’s LTC Legal Brief, “Labor Law Implications of Volunteers
for Health Care Providers” and “The Use of Survey Findings in
Fraud and Abuse Prosecutions”, Long Term Care Survey and
Certification Guide, Eli Research, Inc., 2000.
His primary area of practice is healthcare law,
including Medicare and Medicaid reimbursement, fraud and abuse,
HIPAA, corporate compliance, regulatory and licensure matters,
real estate tax exemption matters and corporate issues. He has
provided representation in hundreds of cost-based and case mix
Medical Assistance appeals, involving a broad spectrum of
reimbursement issues confronting providers. He has been involved
in numerous tax exemption appeals and corporate and regulatory
compliance matters. He also has helped long-term care providers
develop successful corporate compliance plans. Mr. Marshall has
participated in providing representation for clients before the
administrative and judicial tribunals of the Commonwealth of
Pennsylvania, including the Bureau of Hearings and Appeals, the
Courts of Common Pleas, the Commonwealth Court, and the Supreme
Court of Pennsylvania.
Currently, Mr. Marshall is a member of the American
Health Lawyers Association and the Pennsylvania Bar Association.
He has lectured before the Pennsylvania Health Care Association,
the Pennsylvania Association of Non-Profit Homes for the Aging,
the New Jersey Association of Non-Profit Homes for the Aging, the
American Health Care Association, and the American College of
Health Care Administrators.
